Shampoodles LLC — General Liability Waiver

This General Liability Waiver ("Waiver") is entered into by and between Shampoodles LLC, a Missouri limited liability company ("Shampoodles," "we," "us," or "our"), and the individual scheduling or receiving grooming services ("Client," "you," or "your"). By scheduling an appointment with Shampoodles LLC, allowing our groomer access to your property, or permitting grooming services to be performed on your pet(s), you acknowledge that you have read, understood, and agree to the terms of this Waiver.

This Waiver supplements and should be read in conjunction with our Terms of Use and Privacy Policy. In the event of a conflict between this Waiver and those documents, the terms most protective of Shampoodles LLC shall govern.

1. Property Access and Entry

Shampoodles LLC operates as a mobile grooming service and may perform services at your home, place of business, or other property you designate ("Premises"). By scheduling an appointment, you authorize Shampoodles LLC and its groomers to access the Premises for the purpose of providing grooming services.

• You represent that you have the legal authority to grant access to the Premises, whether as the owner, tenant, or authorized representative.
• If you provide Shampoodles LLC with a key, access code, lockbox combination, or other means of unattended entry, you do so voluntarily and assume full responsibility for any consequences arising from that access arrangement.
• Shampoodles LLC will exercise reasonable care while on your Premises. However, we are not liable for incidental contact with or minor damage to property that occurs in the ordinary course of accessing, setting up, or performing grooming services, provided such contact does not result from gross negligence or willful misconduct.
• You agree to ensure that the access area is reasonably clear and safe for our groomer and equipment. Shampoodles LLC is not liable for damage or injury resulting from hazardous conditions on the Premises that were not disclosed to us prior to the appointment.
• Shampoodles LLC is not responsible for the security of your Premises before, during, or after a service appointment, including in cases where unattended access was granted by you.

2. Pet Care and Grooming Risks

Grooming involves physical handling of animals and carries inherent risks. By scheduling services, you acknowledge and accept the following:

• You represent that your pet is in generally good health and that you have disclosed all known health conditions, behavioral issues, allergies, injuries, sensitivities, or temperament concerns that may affect the grooming process.
• Shampoodles LLC is not liable for injury, illness, stress reactions, or death resulting from undisclosed health conditions, pre-existing conditions, or a pet's reaction to standard grooming procedures when reasonable care has been exercised.
• Grooming may occasionally reveal pre-existing conditions not previously visible, including but not limited to skin irritations, ear infections, matting-related skin damage, or parasites. Discovery of such conditions does not constitute negligence on the part of Shampoodles LLC.
• Senior pets, pets with chronic health conditions, and pets with anxiety or behavioral issues carry elevated risk during grooming. By proceeding with service for such pets, you expressly acknowledge this elevated risk and release Shampoodles LLC from liability for adverse outcomes when reasonable care has been exercised.
• In the event of a medical emergency involving your pet, Shampoodles LLC may seek emergency veterinary care on your behalf. You authorize this action and agree to be responsible for any resulting veterinary costs. We will make every reasonable effort to contact you before taking such action.
• Shampoodles LLC is not liable for minor nicks, cuts, or skin irritation that may occur during grooming of matted, sensitive, or difficult-to-groom coats, provided reasonable care was exercised.

3. Interactions with Other Pets and Animals

Our groomers may encounter pets other than the pet scheduled for grooming while on your Premises. This includes pets belonging to you, other household members, or third-party caretakers present at the time of the appointment.

• You are responsible for securing or managing any pets not scheduled for grooming during our visit. Shampoodles LLC is not liable for injuries to our groomer, equipment damage, or disruption to services caused by unsecured or unmanaged animals on the Premises.
• Shampoodles LLC is not liable for injuries, illness, or behavioral changes in non-groomed pets that result from incidental contact or proximity to our groomer or equipment during a scheduled visit.
• If our groomer determines that the presence of other animals creates an unsafe working environment, we reserve the right to pause or discontinue services until the situation is resolved.

4. Third-Party Caretakers and Authorized Representatives

Clients may arrange for a third party — such as a family member, friend, pet sitter, or property manager — to be present at or grant access to the Premises in place of the Client.

• By scheduling an appointment and designating or permitting a third party to act on your behalf, you represent that such person is authorized to grant property access, hand over your pet, and make reasonable decisions regarding your pet's care during the appointment.
• Any agreement, consent, or authorization given by a third-party caretaker on your behalf is binding on you as the pet owner and Client of record.
• Shampoodles LLC is not liable for miscommunications, disputes, or adverse outcomes arising from instructions given by a third-party caretaker that differ from your preferences, provided we acted in good faith on the information available at the time of service.
• If no authorized person is present and unattended access has not been arranged in advance, Shampoodles LLC reserves the right to cancel the appointment. Cancellation fees may apply as described in our Terms of Use.

5. Pre-Appointment, Post-Appointment, and Transit Liability

Our liability is limited to the period during which grooming services are actively being performed. Specifically:

• Shampoodles LLC is not responsible for the condition of your pet prior to the commencement of grooming services, including any health issues, injuries, or behavioral changes that existed before our groomer arrived.
• Once grooming services are complete and your pet has been returned to your care or the care of an authorized third party, Shampoodles LLC is not liable for any subsequent injury, illness, behavioral change, or adverse reaction, except where directly and demonstrably caused by our grooming services.
• Shampoodles LLC does not transport pets. We are not liable for any incidents involving your pet during transit to or from our service location.

6. Client Data Collection and Storage

In the course of providing grooming services, Shampoodles LLC collects and stores certain personal and pet-related information, including but not limited to your name, address, phone number, email address, and details about your pet(s) such as breed, age, health history, behavioral notes, and grooming preferences. This information may be used to provide and improve our services, for marketing, promotions, social media, and to communicate with you about appointments and your pet's care.

We take reasonable administrative, technical, and physical measures to protect the information we collect and maintain. However, no data storage or transmission system is completely secure, and we cannot guarantee the absolute security of your information. By using our services, you acknowledge and accept this inherent limitation.

7. Data Breach Notification and Liability

In the event that Shampoodles LLC becomes aware of a security breach that results in the unauthorized access, acquisition, or disclosure of your personal information, we will notify affected clients in accordance with Missouri's data breach notification law, RSMo § 407.1500. Our notification will be provided in the time and manner required by applicable law.

By using our services, you acknowledge and agree to the following:

• Shampoodles LLC will make good-faith efforts to protect your data and will notify you promptly if we become aware of a breach affecting your information, consistent with our obligations under RSMo § 407.1500.
• To the fullest extent permitted by applicable law, you release Shampoodles LLC from liability for damages arising from a data breach that occurs despite our reasonable security measures, including but not limited to breaches caused by third-party service providers, cyberattacks, or other circumstances beyond our reasonable control.
• Nothing in this Waiver limits our statutory obligations under Missouri law or any other applicable data protection regulation. Our notification obligations under RSMo § 407.1500 are not waived by this document.
• You agree that in any claim arising from a data breach, Shampoodles LLC's liability shall be limited to the direct damages actually incurred and shall not include consequential, incidental, punitive, or speculative damages, to the fullest extent permitted by law.

8. General Release of Liability

To the fullest extent permitted by applicable law, you, on behalf of yourself and your heirs, successors, and assigns, hereby release, waive, discharge, and hold harmless Shampoodles LLC, its members, managers, employees, contractors, and agents from any and all claims, demands, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• The provision of grooming services to your pet(s);
• Access to and presence on your Premises;
• Interactions with your pet(s) or other animals on the Premises;
• Actions taken by authorized third-party caretakers on your behalf;
• The collection, storage, or breach of your personal or pet-related data, subject to our statutory notification obligations;
• Any pre-existing condition of your pet or Premises not disclosed to us prior to the appointment;

— except where such claims arise directly from the gross negligence or willful misconduct of Shampoodles LLC.

9. Limitation of Liability

IN NO EVENT SHALL SHAMPOODLES LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE SERVICES PROVIDED UNDER THIS WAIVER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, SHAMPOODLES LLC'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO GROOMING SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE APPOINTMENT GIVING RISE TO THE CLAIM.

10. Governing Law

This Waiver shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. Any disputes arising under this Waiver shall be subject to the exclusive jurisdiction of the courts located in Missouri.

11. Severability

If any provision of this Waiver is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

12. Acknowledgment

By scheduling a grooming appointment with Shampoodles LLC, you acknowledge that you have read and understood this Waiver, that you agree to its terms, and that you are entering into this agreement voluntarily and on behalf of yourself and any authorized third parties acting on your behalf.
